URGENT -- Reg. appeal for family visa

Post by old_ben » Tue Sep 14, 2004 10:17 am

Hi ..

I am quite new to this forum .. need help in bringing my mom here. My mom was here this year for about 5.5 months (Jan - July). I want her to be with me for some more time as she is alone in India. I applied for her family visa this time but for 1 year and her visa got refused based on Article 8 of ECHR, and the reason is as follows " I have considered the provisions of Article 8 of he ECHR , bu i considered that refusal of entry clearance did not interfere with family life for t he purposes of article 8(1) as the applicant could still enjoy family life with his family by visits to india by his relatives in the UK.
An appeal however lies against this in form N2 which was handed over to my mom .. Can she appeal .. in which case how .. please help ...

thanks in advance ...

Search the forum for posts by ND and MalikN on the same topic that has been covered extensively - doing some leg work helps your cause. It is useful to know:

1. your visa status in the UK

2. whether you are employed

3. Your accomodation details - rent/ mortgage

4. Other relatives in India and in the UK

The Immigration Tribunals have consistently ruled the Home Office to be correct in refusing applications where an applicant relies on Article 8 and it is deemed that the circumstances in question are not compelling enough to override maintaining effective immigration controls.
