UK daughter's expired passport - will she lose her citizensh

UK daughter's expired passport - will she lose her citizensh

My daughter is 7 years old living in the US for nearly 5 years now. We are both British and she has dual nationality. Her British passport expired a year ago but her father refuses to renew her passport. Ad will only allow her to travel on her US passport. I just want to be sure that not having a British passport at this age won't affect her eligibility to retain her British citizenship, and if it does legal action may be required to persuade her father to co sign to renew the passport from the USA.

British citizenship isn't lost if you don't have a passport. If she wanted to move back to Britain, it would be better if she got her new UK passport before she travels so she enters as a UK citizen. On her US passport, she would be entering the UK as a US visitor.

The US require US citizens to travel in and out of the US, on their US passport.

The UK, unlike the US, allows its dual citizens to travel on the travel document of another country. When she is entering the UK, if she can prove that she is a British citizen, by carrying her expired passport for instance, they would typically let her into the country as a citizen. This is certainly not recommended, but is not impossible.

Also, there is no legal requirement for a British citizen to possess or carry a passport or other ID, unlike other European countries and some states in the US.

So, by not applying for a British passport, your daughter does not lose her British citizenship.

It may be worth investigating if your daughter can get a Certificate to Right of Adobe stamped into her US passport. That will allow her to return to the UK as a citizen any time. Be aware though, that it is not typically issued to somebody who already has a UK passport. But if you can provide a valid reason for that, and submit the US passport, it might be possible.
