Finance Clarification for Remain in UK with Family visa.

I am a British Citizen and we are trying to get a visa for my soon-to-be wife who is a Chinese National. She is currently in the UK on a student visa.

We are looking to get an 'Apply to Remain in the UK with Family (2 year route)' visa. We seem to conform to the conditions listed within the guide.

For the 2 year route eligibility it specifies that you must prove 'you and your partner have enough money to adequately support and accommodate yourselves and any dependants without relying on public funds'.

I was wondering if anyone could help to clarify how much money is needed for this and different ways that we can show we have adequate finance in place.

It is no longer a 2 year route. It is a 5 year route as a spouse of British Citizen. Are you apply before or after you are married?

I am not sure what link you are looking at but the rules changed in July 2012. The correct link is below for the form and the guidance notes :

The financial requirement for this visa is that the sponsor (you) must earn £18,600pa (if there are no children) and your partner will need to meet the English A1 test. You will also need to be able to accommodate yourselves.

It says that there is a 2-year route and a 5-year route.

Am i right in thinking we can apply for the 2-year route, or is that only for people who have previously had a partner visa?

Just a bit further down on the link you have provided it says :

You can only extend your ‘family of a settled person visa’ in this route if you:
applied as a partner before 9 July 2012
are not eligible to settle
have kept to the terms of your visa
or is that only for people who have previously had a partner visa?
Correct. So this route would not be possible for your partner.

For the 5 year route, is there a way to get around having the £18,600 per year income, such as having a certain amount of money in your bank for a certain amount of time.

At the moment I am a student and therefore can't get a job with that income at this point in time, but it is possible that someone could gift me a large amount of money for this purpose.

With no income you would need to have £62,500 in accessible funds which have been held in your account for at least 6 months. As your fiancee is already in the UK, joint income will be considered.
(Casa, not CR001)
