hi. i m uk national and married to guy in india and remain in india together for 3 yrs.we have a kid. and she also has uk nationality.
my question is now i m going back to uk with my kid and bring my husband to uk.
i will be living in london with my parents. i am a house wife and graduate. my uncle has departmental store in bristol and he says he can give me job on papers to meet 18600 requirement. but in actual i will not do the job and remain home. can u tell me if this will cause any issues? if yes how can i justify this job? can i tell immigration officer that i do work from home? like may be cold calling to customers and thats my job responsibility ? plz help me and advise

What you are proposing could be viewed as deception or using false documents.

You won't be able to submit the application until you've been employed for 6 months and earning the equivalent of £18,600 per year. So as CR001 has already advised, you will have to submit 6 months of pay slips showing tax and NIC deducted and 6 months of corresponding bank statements as confirmation of the wages being paid. Is your uncle prepared to pay you a salary and also pay tax and NIC to HMRC for a job you won't actually be doing?
This plan isn't going to work and could result in your husband facing a 10 year ban.

yes he will give me 1550 pound per month job offer. and will transfer them to my account each month for 6 months. each month i will return complete 1550 back to him (i know i will have to put 143 pound approx from my pocket to return complete 1550 back to uncle)
and once 6 months are done . i will have 6 pay slips and bank statement and tax deduction shown.
does immigration officer really do monitoring if i daily go to job???
secondly since job location is different from city i am living. can i somehow tell officer that me doing work from home? like virtual assistant or something? plz guide

You are digging yourself into a deep hole. Don't think for a minute that the case worker won't catch on. As soon as the 1550 goes in and straight out of the account, suspicions will be raised.

There is tax to pay in real time, and national insurance. On top of that, the employer has to pay double national insurance on their side. Its not £143, you are looking at loosing at around £360 per month in deductions.

If I were you, I'd concentrate on getting a real job that pays at least £18,600, even getting 2 jobs if that is what it takes. Do things legitimately otherwise you are risking all future applications having used deception in a previous application.

I'm going to give the OP credit for asking for advice BEFORE they are thinking about using deception as the OP still has a choice to make the correct decision unlike another poster on this forum asking for advice AFTER using deception and being caught out as you are aware, "the falsely declared HMRC tax issue" for which it is too late to do anything.

regarding 1550 pound giving back to employer will raise alarm for immigration officer. here is how to beat that. i will not be taking out all and sending at once. i will spend 1550 pound normal for daily expense. and will return to employer from other channel (that is cash saving i have in hand , not in account or may be i give cash back later not an issue since its my uncle)
well doing 360 pound on top is a new point for me.i will add up in my calculation as i have to spend it from personal saving.
so all above points covered. am i good to go? please advise

I don't think you will find anyone on this forum who will tell you it is ok or 'good to go' to do what you want to do as it is not a true representation of your circumstances and you will in effect not be telling the truth (= deception) for the purpose of a visa application.

CR001 is right when she says that no one (certainly not moderators) will assist you in deception. Apart from the legal aspect, it's a catalogue for disaster. Entry Clearance Officers are highly skilled in identifying false information in visa applications. They will spot immediately the fact that you are employed in a department store nowhere near you where you live and 'cold calling' for £18,600 a year is never going to convince them that you are genuinely employed. If you follow this idea through, the sad fact is that we're likely to read your posts further down the line asking how to appeal against a 10 year ban for your husband.

This is not the forum where you will get advice on how not to get caught on use on deception. Its for helping people who genuinely need it.

All its take is someone to do a little digging and its game over. London to Bristol is like a 250 miles round trip, almost taking 4-5 hours. You Earn exactly £18,600, not a penny more or less. Job description not matching pay. HMRC will have all records of tax payment, you only paid for the six months submitted, no employment before, and it can take 3 months, 6 months for application to be decided and all it takes in case worker to check CURRENT status with HMRC when considering application, no tax being paid, this is just to name a few. This is what I can think of just on top of my head. Think of what the case worker can do with all your details at hand and all the resources at their disposal.

Do you really think your husband will get through an interview if he's questioned in detail about your employment? It would need a miracle.

There is only one reason the OP is asking for advice openly in a public forum for using deception: FEAR.

Its the fear of getting caught and the OP wants assurances all will be alright. Why else confess to wanting to use deception. As soon as the application is submitted, the fear will set in and the sleepless nights begin. What if the UKVI catch on, what if they discover this and that and the stress of knowing there is always an change she will be caught out. The application will be take longer to decide as the more deeper the case worker digs in, even up to a year. Both the applicant and the husband will have a high change of being INTERVIEWED. Then the decision, refusal by use of deception and we will all be saying "I told you so".

£18,600 is not much really - you can earn that with two or three jobs, cleaning, McDonalds, pub in the evening, you should do it the honourable way, not dishonestly and shamefully like this.

I cannot stand deception of any kind. To be so blatant about it and expect other peoples advice on how to circumvent the immigration rules is deplorable. Thankfully, we have trained Caseworkers that identify such offenses.

Your feeble attempts to produce a fake job with fake earnings will be uncovered and any application will be refused. FYI, this board is a useful source of information for caseworkers as well as applicants.

Perhaps if you put such efforts into finding a job that earns £18,600 you might be able to do things the honest way, like the majority of the law abiding public.
