ILR Dependent - Extension from India

ILR Dependent - Extension from India

Hi All,

My ILR is approved on 11/06/2015 @ Croydon PEO (under Tier1 5 Years route). My wife is currently in India, her T1 dependent visa is due to expire this september.

She is planning to return back to UK around Dec 2015 (together with our new born baby). I have to make a passport application for my new born baby who is currently in India. can somebody answer my following questions:

1. Is an NOC(issued by High commission of India) compulsory for making a passport application for a new born baby?
2. As my wife's T1 dep visa is expiring in sept 15, what are my options(categories like ILR dep or PBS dep or FLR,M ect) for extending her visa?
3. Can i extend my wife visa first, before it expires and then make a separate application later on for my baby when her new passport is issued.
4. What are the funds maintenance requirements i.e maintaining a min of £££. for 90 days for ILR dependents? apart from reaching an earning threshold of £22,500 pa?
5. What is the best visa categories for my wife and baby.

2. After you were granted ILR, she cannot apply for entry clearance as a PBS dependant. If she and baby are to return after her leave expires, then they may apply to join you as family members of a settled person under Appendix FM. Unfortunately, her qualifying period for SET(M) may be reset.

3. No, extensions are only possible, if she is in the UK.

4. They will be subject to Appendix FM-SE.

5. If your wife has been your dependant for at least 2 years, then it may be better that baby and mother return as PBS dependants before mother's leave expires in September. Then, they may extend as PBS dependants until qualifying for SET(O).

can you please shed some light on my below queries:

If I apply for Entry clearance as PBS dependent for my child(only) in India before my wife's leave expire in september, then:
1. Do i have to meet maintenance requirement of 2 dependents(i.e for my wife + Child) = £965 + £630 +£630, even though I will be making an application for my child only?
2. Will my child get a visa validity upto this september only (i.e when my wife's leave expire)? Or Will the child gets more than 2 years valid leave?
3. Will there be a premium service available to apply for "Joining family of a settled person" for my Child only from India, then this way I may get the child's visa validity for a longer period. Then my wife and child can return before september and I will only need to extend my wife's visa upon their return that would save me some money.
