Looking for some advice (SET (M) and Divorce)...

Hi Guys,

This is my first post, and I am looking for some advice! Firstly let me tell you the details...

I am a British Citizen, born and Breed in Yorkshire, I was Married to my wife (Chinese) in May 2011, where she was given a 2year marriage visa, we had a Child in the Summer or 2012, in 2013 we applied for a SET(M), this was successful and so she has indefinite stay, unfortunately we failed for divorce in September 2014! The Decree Absolute should be complete by the end of the month!

I currently have my son 5.5days a week and she has him the remaining time!

Question is, this page https://www.gov.uk/visas-when-you-separate-or-divorce, seems to tell me I have to write to the home office, however, my ex is saying that we don't need to do anything! So what I would like to know is, is she right, or is she saying this so she doesn't have to reapply for a visa?

Once the person has ILR, you dont need to inform UKBA about breakdown of marriage as she is free from all the immigration rules
