Discretionary Leave to Remain

I am drom mauritius my son is british citizen so his dad, but we are not married, i want to be here for the upbringing of my son and a better future. i applied for leave to remain but got refusal due for not enough information. what to do now as i do not want to go back.

Are you named as the mother on the child's birth certificate?
What is/was your immigration status since you arrived in UK?

Yes both our name on the birth certificate, I was a student when i got pregnant and had the baby 2013. I had to go back as visa was about to expire and also baby went with me as I was still breastfeeding. I came back on visitor visa for the baby to see the dad.

Firstly, you can not change from a visitor visa to any other visa within the UK. You have to return to your country of residence.

Secondly, being the mother of a British citizen or even being married to one does not give you any right to settle in the UK.

Typically, to settle in the UK as the parent of a British citizen, you have to prove (with evidence such as a custody order from a court) that you are the sole carer for the British citizen child. You may also have to prove why the British parent can not look after the child.

If you can prove that you are the sole carer of a British citizen child, then you can apply for leave to remain. It will be 10 years for you to get ILR and 11 years to get citizenship under current rules.
