ILR for Spouse

Post by immiquestion » Thu Feb 18, 2016 3:57 pm

Hi

I have a question with regards to my situation, I am on ILR eligible for citizenship May 2016. My wife is on a tier1 dependent visa and she will be eligible for ILR Nov of 2017 once she completes 5 years. I have an opportunity to move out of the UK for a job and wanted to find out what happens to my wife dependent visa/eligibility for ILR next year if I decided to move.

Many thanks

Until she gets ILR, your wife is dependent on you being in the UK. If you leave, the basis for her visa/leave to remain ends.

Then if you return, she will need to start all over again, under the rules in effect at that point in time.
