Relevant date of application

Could moderators/gurus please advise?
When is the relevant date of application FLRM which was made in May 2016 after the couple were married in April 2016, based on self employed of British spouse. The financial requirement evidence was provided for the last financial year before the application i.e. April 2015-16.

The Home Office are asking now asking for financial requirement from 2013 because the applicant who initially was granted a Tier 4 student visa, applied for a tier 1 visa, then switched to FLRO before switching to FLR M finally.

Home Office are saying relevant date of FLR M has to be 2013 which is when the applicant varied his Tier 4 application despite the fact that he didnt even know his spouse back then.

Is this legal???
