What are sufficent funds for ILR

What are sufficent funds for ILR

Evening

Could anyone please advise what the home office would consider as sufficient funds when i am applying for ILR from a spousal visa?

Are you required to have minimum savings or if you are employed full time does this meet the requirement?

Has anyone been refused a visa based on lack of funds?

9.3 - Maintenance: General requirements wrote:There is no explicit minimum figure for what represents sufficient maintenance. However, in 2006 UKAIT KA and Others (Pakistan), the AIT strongly suggested that it would not be appropriate to have immigrant families existing on resources that that were less than the Income Support level for a British Family of that size (See Paragraph 8 of the determination - available on the Asylum and Immigration Tribunal website). If it is more likely than not that the total amount that the applicant and sponsor will have to live on will be below what the income support level would be for a British family of that size, then it may be appropriate to refuse the application on maintenance and accommodation grounds.
It may help if you can include a monthly budget to demonstrate that you, as a couple/family, will not need to rely on (additional) Public funds. Don't panic!

As with granting leave to remain (paragraph 3.4 above refers), indefinite leave to remain is rarely refused on maintenance and accommodation grounds - either on their own or in combination with other grounds. To ensure a consistent approach across UK Border Agency, maintenance and accommodation should be included in the grounds for refusal only with the agreement of an SEO or above.

I am a British citizen on DLA (disability benefits) and my wife is due to apply for ILR in six months, which one month after the introduction of the new family rules.

My wife is unemployed and is looking after me. I also receive financial support from my family and have five thousand pounds savings. I also own my my house.

Could my wife be refused ILR because we don't meet a possible new income threshold.
