Case Description:
Currently, I am in India wishing to work and live in the UK under the HSMP visa regulation. I have 100 HSMP points. I worked in Australia for 12 months (from March 2007 to March 2008).
My wife was also in Australia on a Student Visa (from Jan 2007 to Sep 2007). Her student visa was automatically cancelled due to low attendance. She applied for revocation as she completed her first term with good grades and her intentions were good to stay further and finish her studies. After applying for revocation she came back to India for our wedding. While we were in India, she received a notification, not to revoke of her visa cancellation.
After the wedding, I applied online for a dependent visa for my wife on the 6th Dec 2007. Initially, we waited for about six weeks (as the time required to process dependant visa). After six weeks, I started calling Australian embassy and in one of the conversations with them I discovered that my wife's has an exclusion of three years due to earlier student visa cancellation. Neither my wife nor I was aware of this exclusion till this moment.
After few more weeks, the immigration officer told me that the exclusion will not be removed and you have a choice to withdraw your application so that no refusal is recorded against my wife's name. We decided to withdraw the application.
