Leaving country after EEA2

Post by kate8118 » Wed Apr 16, 2008 10:33 pm

Hi everyone,

My EEA2 residence card was granted in 2007 (expiring in 2012). I just wonder what would be an effect if we decide to move abroad for a year or two and come back to UK later. Should we come back to UK before 2012, do we still need to reapply for a new EEA2 or the old EEA2 we have will still be valid for use?

Many thanks for your advice.
Kate

You can be gone from the Uk (or any other EU member state you have a Residence Card from) for up to 6 months (per year) without loosing it. 12 months if it is for training or childbirth. Please read Directive 2004/38/EC for more details, or the Guide to Getting the Most out of Directive 2004/38/EC.

If you are not gone for more than those 6 months during the 5 years, then you automatically have Permanent Residence in the Uk. At that point you can leave for up to 2 years without loosing it.
