My wife overstayed in uk 320(7b) for 10 months

Post by Josh1990 » Mon Mar 18, 2019 7:16 pm

Hi everyone, I married my US wife in Las Vegas in 2017. We flew back to the uk with the intention of filing for a spouse visa. We didn’t get round to doing that and before we knew it she had overstayed by 10 months. With work issues for myself through winter I couldn’t pay for her return flight back to the US and therefore she made a voluntary return with help from the Secretary of State. She did leave within a few weeks of putting the papers in. She was also subject to a 2 year re entry ban. That’s all she did that was wrong. My question is because she fell into the 320(7b), could we possibly get a spouse visa as long as we meet the financial requirements and how long would it take before we could do this?

Any help would be greatly appreciated! 😊
