Bankruptcy in home country affecting ILR application?

Post by brokentelephone » Mon Feb 08, 2021 4:42 pm

Hi --

A friend of mine is already living in the UK on a spousal visa (its been renewed once), and is set to apply for ILR in the next 12 months. She has completely cut off all connections with her home country (Canada), however, she has had some financials issues in the past year and is unable to pay her credit card debt in Canada. She has no intention of moving back to Canada, and is unconcerned if her ability to do so is limited.

If she were to declare bankruptcy in Canada, as a Canadian citizen, would this affect her ability to obtain Indefinite Leave to Remain in the UK? I know there have been threads about declaring bankruptcy in the UK and ILR/Citizenship issues vis a vis character, but I haven't seen anything about declaring bankruptcy in the home country.

Any help would be appreciated.

KR.

Hello

Ignore that. Why would you declare this? You are not obliged to declare worldwide financial issues. Ok, she had an issue with credit cards in Canada. But she is in the UK. Issues with credit cards are not a crime that goes down the criminal records and needs to be declared as you go around the world.
