Sole responsibility UK

Hello. Can you help please.

I am a UK Citizen by birth and I am getting married in June in the UK to my future wife M who is Russian (she has a 7 yo child A from an annulled marriage) . I should confirm M has travelled at least 6 times to London on tourist visa with A ( the father has signed a letter allowing her travel out of Russia) . M has applied for a marriage visa for the June UK wedding and will return to Moscow and apply for a family visa but here is where we need clarification of the following .. the worry is not M's visa but A's and simply is the following

under UK immigration rules for the Family Visa

As a single mother (divorced from A's father for 2 1/2 years, separated for 5) how does my fiancee prove she has "sole parental responsibility" for the purposes of her daughter (7 years old). Is a notarised letter from the father sufficient or does there have to be a Russian court judgement.

The father has no input financially or otherwise , he sees the child maybe 1 every 6-8 weeks for an hr, irregularly.

My fiancee also has Sole Responsibility ( no involvement or participation from the father in these decisions) for the last 5 years for : but what documents are the home office accepting, as a court judgement seems pretty drastic and could potentially be withheld by the father.

Their education; no father involvement
The faith they are raised in; no father involvement
Whether they undergo certain medical procedures; no father involvement, and there have been several as the child has a medical condition
What recreational activities they take part in; no father involvement
What to do with the child’s property; no father involvement

The issue here is that the father still has access to the child because the mother requires the father's consent for the child to allow him to travel outside of Russia. I would suggest you work with the father to see if you can both go to the court and have a agreement in place including a letter from the dad that the child will be visit the father yearly or some sort. Some people have used letter from the other parent but i do not believe the letter is enough because there's no legal binding behind it so it is better to go through the court.


Assuming the father has no involvement from day one then in this case, you do not letter from him as you can proof sole responsibility by showing evidence that the mother has been making key decision in the child's upbringing.
