spouse visa

Post by GMO » Tue Dec 14, 2021 7:38 pm

Hi,

If someone starts a job mod of the month ( for example 13th November) with the salary threshold 18k++ then obviously on the first month payslip it shows lower payment as started mid of the month.

my question is, the person can use that joining month payslip + next 5 months payslip for spouse visa application or do they have to count the payslip from the next 6 months where it shows the full amount. Experts, please advise.

Thanks in advance.

Depends if the person is in 'salaried' employment or 'non-salaried' employment.

If salaried, then the UKVI will use the lowest amount of salary recieved during the 6 month period and times that by 6 to calculate if the financial requirement is met.

If non-salaried, the UKVI will use the total salary received in the 6 month period to see if the financial requirement is met.

Thanks for your reply. The person is the monthly salaried employee with a payslip. So he can use the initial month payslip ( started mid of the month) and the other five full month payslip for application or he needs full 6-month payslips showing his full salary credited to the account.

Yes but UKVi will use the lowest amount salary and times it by 6. The lowest salary would expected to be in month 1 and so it may be the case that the financial requirement is not met and will have to wait for the following month.

Please also bear in mind that CAT A (i.e. 6 months payslips) can only be used if with current employer for at least 6 months. It may be clear from the dates provided on the application for that the employment has not been held for at least 6 months prior to the date of application. In this case, CAT A cannot be used.

Thank you.
Well. If someone joined and works 3.5 months in a job and after that find a better opportunity and moves to a new job ( both jobs fulfil the salary threshold) then can he apply with a 3-month-old job payslip and 3 months newly joined payslips? or he has to wait 6 month again to the new job! Experts please advice.

CAT A can only be used to meet the financial requirement if you have been employed by the same employer for at least 6 months.

If you have been employed by your employer less than 6 months then you cannot use CAT A to meet the financial requirement. You will have to use CAT B.
