Self employed UK citizen relocating back to UK with spouse

Post by noodles72 » Sun Jul 16, 2023 7:26 am

Hi,
I'm a UK citizen that has been living in China for the last 20 years. I am self employed, I have been contracting for the same company based out of the US, working worldwide for the last 15 years. Work is irregular but I earn way over the threshold, I do not receive pay slips, just bank deposits.

I am looking into how I can get my wife a spouse visa and I believe that although I earn enough because it is irregular this may not be acceptable.

It seems my best bet would be to move back to the UK first on my own, my company have agreed they would put me on a fixed contract and issue payment slips if I do this. So then after 6 months I could apply for my wife's visa.

Does this seem like the best course of action or is there anyway of applying sooner just using bank records.

Thanks

Do you have savings of £62,500 held for last 6months?

No, unfortunately I can't go that route.

It appears the option you outlined in your initial post may be the way to go.

Can your employer give you a confirmed job offer, that pays at least £18600 and that starts within three months of your planned return to the UK?

If you have such a confirmed job offer AND proof of having earned at least £18600 in the year immediately preceding the application, you may be able to apply for your spouse to accompany you to the UK.

However, do not count on such an application to be decided in three months. You may well have to return to the UK and start the job. But your spouse may be able to join you earlier than under the route that you stated.

That's interesting, thanks. I can absolutely get the confirmed job offer in that time scale. Do you think bank statements are enough proof of previous earnings. The deposits are quite clear.

I'm ok with going back first but it would be nice to reduce the time from 6 months.

Bank statements AND payslips/salary statements or appropriate tax statement (i.e. two sources of proof from separate bodies).
