British National Student Studying Abroad - Spouse Visa

Post by ukdoc2024 » Wed Nov 22, 2023 10:58 am

Hi Everyone,

Sorry my post , Hopfully I have posted in the corerct category.

My daugher (20 years old ) is a British Citizen (we came to UK in 2009 and got our British Passports in 2016

She is studying Medicine in Romania.

We are planning to get her married (Nikah in 2024) . I have read the requiremems that she need to have a job for atleast £18,600 and will need 6 months salary slips too.

My queries:
1) She is a student, what financial evidence can be shown to meet the financial conditions as she is not doing any job, she has savings of around £20k in her bank account.
2) Can we use the option of cash savings ( it will be parents savings ) that we will transfered in her account.
3) We plan to do Nikah in Mid 2024 in Pakistan , and she will be back in UK and then twill continue her studies in the EU country. Will it make any problem when she applies for her spouse visa as there will be gap of approx 1 to 2 years in (Rukhsati) in the mena time she will be visiting Pakistan ocasionally.

Any other sugegstions from seniors or any one who has gone through the similar situation will be appreciated.

If not employed and not earning £18,600 she is not able to meet the spouse visa requirements. Between these two points there is no grey area.
2) Can we use the option of cash savings ( it will be parents savings ) that we will transfered in her account. No

It will not be a straight forward application. And that assumes the financial criteria are met in the first place.

Any other sugegstions from seniors or any one who has gone through the similar situation will be appreciated.

Thanks for your reply.

So that means she need to finish her studies first ie 2027

Register with GMC in UK , get her 6 pay slips and then apply for the spouse visa.

Or

If she starts any part time time job in between her completion of studies and manage to get £18,600.
Can she be able to apply for spous evisa while completing her studies in the EU.

Also in that case (if application is successful) her spouse can come and stay in UK and can she complete her studies in EU?

What is the average time for the Spouse Visa application?

Spouse visa is given for the purpose of reuniting the family, so spouses can live together in the UK. How will your daughter achieve that while she's studying in Romania?

They might be better off living together in Romania? Does daughter even want to return back?

During the holidays, term breaks in her UNi in EU, daughter is in UK.

She has completed her primary, secondary eductaion and graduation from UK and now in EU for her studies.

Once studies are completed she will be back in UK to join NHS as a Junior Doctor.

There's no magic route that allows this - if they want to return back, they have to apply for spouse visa anyway, for which either savings or a job in UK is needed.
About staying in Romania, you have to consult Romanian law, doubt there are many experts on it.

Or husband can find a way to stay in UK on his own, like Skilled Worker visa.

If the daughter takes a break from her studies for a year, do a job ( fulfill ) £18600 finnacial requirement, and then apply for spouse visa.

After that can she carry on with her studies. Any implications on the spose visa extension?

Also can she use the route "discretionary leave to remain spouse visa" mentioning "exceptional circumstances"

She has only gone to EU for studies and her main homeland is UK. She will be fully they are completed, can she not apply the spouse visa explaining all the above situation in the cover letter.

Any special requirement from the spouse side, like the £18600 financial requirement?

Any suggestions on the above scenarios will be extremely appreciated.
