Enquiring about Partner's Visa Application (FLR(M))

Post by imrozanik1992 » Mon Dec 11, 2023 11:50 pm

Hello Everyone,
I need your valuable suggestions on the matter of my dependant partner’s visa application.
My wife joined me in the UK in 2019 as a Dependant Partner when I was on Tier 2 (Skilled Working) visa. During COVID-19 I lost my sponsored job, therefore, I decided to switch to Student Visa for a postgraduate course and applied for my partner at the same time as Dependant Partner Visa. After completing my postgraduate course, I switched my visa to Graduate Route Visa and my wife applied for Dependant Partner Visa. Within 2 months of Graduate Route Visa, I received Indefinite Leave to Remain/Settlement in 09/2022 under 10 yearlong residency route. Currently, I am planning to apply for my partner’s visa extension.

My Partner’s visa timeline:
PBS Dependent Leave to Enter (Dependant of Tier 2 Visa Holder) – 24/10/2019 to 23/09/2022
Dependent Partner Leave to Remain (Dependant of Student Visa Holder) – 08/02/2021 to 04/06/2022
Dependent Partner Leave to Remain (Dependant of Graduate Route Visa Holder) – 20/04/2022 to 20/04/2024.

My questions are:
1. My wife needs to apply for FLM (M), is that correct?
2. If she extends her visa with FLR (M), Does that mean that the 5-year clock starts again?

Please let me know if you want to suggest anything else. I look forward to hearing from you.
Thank you very much indeed.

Since you've gotten ILR based on Long Residency, your partner would need to move to FLR (M). This you've correctly figured out.
Her clock would also reset, as you've also discovered.

Unfortunately, because you've moved around a lot to get to where you are. She has to move with you. She can eventually get ILR based on 5 years as a spouse of someone settled in the UK or Long Residency (10 years) like yourself.

Based on my calculations, I believe the 5 years would come slightly sooner.
No sin in failing, you just have to try and try again!
