I find myself in the strangest of situations right now.
I received an email from the Home Office setting out its decision that my application under the Partner (FLR M) route was successful on 12 December 2023. However, it also stated that I have been granted permission to stay in the UK until 12 June 2023, which is a date that is 6 months before the date of the decision and hence has already expired 6 months ago. In addition, this date is before the date of my application itself (19 October 2023).
I have also received the BRP on 14 December 2023, which similarly states what is set out in the decision email. The BRP is valid until 12-06-2023, while the place and date of issue is 12-12-2023. In other words, the BRP had also already expired 6 months ago by the time that it was delivered to me. While I initially reported a problem with the new BRP on gov.uk, UKVI has advised me to apply for an administrative review because there is an obvious error with the length of stay granted for my visa.
While I have already applied for administrative review today (15 Dec), just in case - I still have several concerns. Firstly, am i able to study or work now pending the administrative review? Technically I am not even allowed to be in the country right now, because my date of stay has already expired! I have got a viva for my PhD coming soon, in Feb 2024, and currently I technically do not even have regular immigration status here. My university has asked me to engage solicitors to advise on whether I can sit for my viva, which is costly, and this is not even my fault. I'm also very concerned because administrative review takes up to 6 months or longer! This is going to be a huge gap on my CV as well. Has anyone found themselves in a similar situation, or have any advice about what I could during this transitional period?
Secondly, could it be that the initial email was sent out as an administrative error, and that my visa application was not actually successful? It was a bit strange that it was decided so quickly, although my case was fairly straightforward I think (we lived together for about 3.5 years in the UK and known each other for more than 4 years, and the requirement for cohabitation is only 2 years). I don't know if I'm overthinking this though.
By way of background, I had made an application for a partner visa from within the UK on 19 October 2023, and submitted my biometrics (along with supporting documents) on 9 December 2023. My previous visa (student visa) had expired on 30 October 2023, but I had already submitted an in-time application by 19 October.
I'd be grateful for your advice, please let me know.
