Spusal Visa / Bankruptcy

Post by nick1976 » Thu Sep 24, 2009 8:33 am

Hi

My wife is from Peru and has been in the Uk since May 2008 on the initial 2 year spousal visa, due for the indefinite leave to remain visa May 2010.

Over the last 15 eyars i have built up quite a lot of debts, but always managed to deal with it, until this year when I have lost 2 full time jobs and a part time job. Having had 3 1/2 months unemployed this year I have fallen so far behind with payments that I have been advised to declare bankruptcy. As we rent accomodation this is not a problem from a housing point of view. All of the debt has only ever been in my name and predates my wifes arrival in the UK.

I am working again now and looking at going to court 1st October to apply for bankruptcy.

With all of this in mind my question is if I apply for bankruptcy now, and all if OK, the Official Receiver end it tidied up before Christmas etc... Will this cause a problem with our visa application in May 2010? I don't see anywhere on the forms that it asks if the English Husband has ever been declared bankrupt, if anything it will mean we have additional savings rather than less. We will both be able to demonstrate regular income and limited savings....
