Hello, I'm a British National born in the UK in 1979, at the age of 7 my father took me away from my mother, step brother and step sister to a another country to be with his wife and 2 other children, in other words kidnapped me really..

6 months later he left and went to the United States without me and when i turned 16 he had me go to him, i entered the country with a visa waiver and my dad started my immigration papers since he became a US citizen a year or so before my arrival into the US.. he never completed my papers properly and with the shuffle that is the immigration system my documents were lost for years and just a few months ago i was denied to stay and was sent a letter asking to leave the country.. i left and came back home to the UK and have since been reunited with my mother, brother and sister after 23 years.

At the age of 20 tho i met my current wife who is a US citizen, we have 2 children both born in the US also, but due to me leaving they had to stay behind in the US while i try to find the best possible way to bring them over but this is where it becomes complicated..

When my father applied for my papers in the US he used a different surname than my birth surname, i think it was a way for him to get out of trouble because he had changed his surname also, and that is the name i used in the US for 14 years, that surname is on our marriage certificate, kids birth certificates etc.. having to come back home I' am now using my Birth surname once more and being here for roughly 3 months i've had to go on Housing Benefits and Job Seekers while i look for work..

I need to bring my family over but not sure where to start, and what to do, my wife has savings in the US that estimate 45k USD which she will be bringing to the UK, she is able to and will look for work as well when she comes and i should hopefully get a job soon but what do i do about the surname issue and applying for them while on benefits etc..

my wife and i have photos of us in the US, phone bills for the last 3 months of me being here, and if they need a DNA test i'll gladly do it, i heard about adding the surname i used in the US to my name here and change my passport bank etc not sure if that is needed though.

Please if someone can shed some light on this matter i would greatly appreciate it..

Are you saying that the name in your passport is not the name you are using now?
How did you change your surname from the one you used in the USA to your birth surname?

No The name I' am using now is my birth name, the same name on my passport and birth certificate.

My father being Egyptian born he had a couple of surnames and he used one while in the UK around my birth and then used another when he was in the US, his birth certificate has both surnames so i assume it was easy for him to do use 2 names but while i was in the US i used the same one he was using and not my birth one..

He never applied for my name change legally but as my immigration documents were being filled out he started using his surname instead of what was on my passport and it became the one i used throughout.

I have Some Immigration documents that date back to when he was applying for me and it shows my REAL surname, i have a copy of his birth certificate showing his surname and my birth one as well..
