Need some clarification

Post by kantg1 » Tue Aug 16, 2005 11:29 am

Hello All,

I have read somewhere that the spouse of a UK citizen will be eligible for PR after 4 years of marriage. I am a spouse of a UK citizen.

my question is

1) Does that mean I can apply for the ILR after 4 years of marriage irrespective of the no. of months I lived in the UK. I lived in the UK for 6 months on a spouse visa.
OR
2) Is it after 4 years of living "outside" the UK.

Please calrify this to me as it is very important for me.

Thanks,
Kantg1

Yes, if you have been married for at least 4 years to a BC, you are eligible to apply for ILR/ILE the UK without having to apply for a probationary 2 years spouse visa.

I believe the ILR/ILE is not connected to how much time you have spent in or out of the UK.

4 year period is that outside the UK and by default on a consecutive basis to exclude short trips to the UK where it is clear that such (visits) are not to a place of ordinary residence. Let me point out that this is but only one of the requirements of the immigration rules - there are others to be met including that pertaining to a subsisting relationship, funds etc.
