SET(M) Questions

Post by tomnomnom » Thu Jan 20, 2011 3:53 pm

Hi all - first a thanks to everyone as your help here has proved invaluable throughout our application and approval for my wife's initial spouse visa (have had to make a new account here as forgot the info after 2 years!)

My wife is from the USA I am a UK Citizen.

We married in Nov 2008, applied for a spouse visa, this was granted in Jan 2009. My wife came over to the UK at the end of Feb 2009, so we are now approaching the end of the (month before) she has been here for 2 years and are looking at the SET(M) application for ILR. Her current visa is valid till the end of April 2011.

We are hoping to apply through one of the PEO Offices as the home office website says postal applications are taking up to 6 months at the moment.

My questions are grouped into 3 sections, input on any of these would be greatly appreciated - they are as follows:

1) Included Documents

In the initial application for my wife's spouse visa we provided many additional documents that don't seem to be asked for this time around in the SET(M) form

For example:
- photos of us together throughout the course of our relationship
- reference letters from people that have known us and seen us together as witnesses of our relationship
- evidence that our housing is "suitable" i.e. letter from local council saying it is suitable for 2 people
- letters from our employers confirming our hours, that we are valuable at work and likely to continue to hold these positions for the foreseeable future
- a budget & breakdown of necessary household bills and expenses
- travel documents for time spent together prior to the visa application

Would things such as this be advisable to include with my wife's application for SET(M) even though they are not asked for? (There is a section at the end for "Other Documents" where you can state what else you have included.) Or could too many documents potentially delay our application?

Also, we are asked to provide 6 letters addressed to us together over the course of the last 2 years. If we are able to provide more than this would this be advisable? (perhaps 10-15 documents to give even coverage of the 2 year period?)

2) Finances

We both work part time, after tax our incomes are:

My wife - £560/month
Myself - £730/month

I also receive annual dividends from shares, these have been around £8,000/year for the last few years.

This makes an estimated yearly income of £23,480

We also have savings of around £14,000

We do not claim any benefits

Our total necessary expenses each month (rent, utilities, food, insurance etc) comes to around £1000

Should this be enough to show financial stability?

3) Addresses & Travel

This is in relation to Section 6 of the SET(M) Application Form.

A) We have lived in two rented properties during the two years my wife has been here. These are obviously to be included.

We have stayed at a separate holiday address in the UK for 2 weeks each year (total 4 weeks) during the last two years. - Do these holiday addresses need to be included in the "previous addresses"
section?

B) We spent Christmas 2009 in the USA with my wife's family this was meant to be for 3 weeks, however due to bad weather in the UK our flight home was delayed by 1 week making the total time spent on this holiday 1 month. We plan on including separate documents discussing and providing evidence of the dates and reasons for the travel outside the UK. - Similarly to part A, would this need to be included in the "previous addresses" section?

Many thanks to all =)
