COA what next? Fiance is a failed asylum seeker.

I am the fiance of a failed asylum seeker and we have applied for a COA. He lives with me at my house which is my mothers and we live rent free.

After receiving the COA and getting married i intend to apply for a spouse visa for him. However he is unable to go back to his country. What is the best thing to do? Can anyone help me please?

I am a british citizen and work full time and have never taken any benefits in my life, i can fully support him as that is not a problem. I just want to know what the next steps are and how i can go about them in order to obtain the spouse visa?

Spousal visas are issued in home country.
Why can he not return home and apply from there?

He is a failed asylum seeker and would that affect him getting the spouse visa from his country? Or is it better to us that he goes home and applies from it there?

My only fear is that he gets stuck out there and cant return to me.
