ILR :Request answer specialy from Modarator please

Post by Kalugampitiya » Tue Apr 18, 2006 8:21 pm

I am in WP visa until 2010. my two children age 17 and 18 and my hasband with me as my dependents. we are sri lankan from colombo.

Today I called the Home Office to get advice from them. My question was '' if I send my daughters to India or South Africa or a EU country for their education will it have an effect when we get our Definite Leave to Remain. '' One advisor said that It will not effect any of my dependant s . The only thing is I ( the Work permit holder) should be here for five years without absence for more than 90 days per year.

My two daughters wanted to do medicine. They are classifying as international student s UK and we have to pay all five years £120,000 per each girl. It will cost us £240,000 for both.

And also I asked from Home Office immigration adviser , w here is this rule appearing in IND web site? He said that “Under our dependent section” .
Is this correct ? If my children go to India or...any country for their education, Can they get their ILR with me on 2010?
Can you please help me to solve this , i would really appreciate your help ?
Kind regards

Kalugampitiya, based upon what you write, if your children study abroad in the way you describe, I can't see how IND would possibly exercise their discretion in their favour and grant them ILR on the back of your own ILR application in 2010. It is just not going to happen IMHO.

Having qualified as doctors then it will depend upon Tier 1 or whatever that is in force in 2010, as to how they get back to the UK.[/quote]
