NEED HELP --- In relation to marriage visa

Post by detset » Fri Oct 07, 2011 11:46 pm

Hi, I am new user here, I need some help/advice.

I am Bi Sexual man, I was in civil partnership with my partner for 2 years and 6 months approx, in that meantime I also received my ILR (Indefinate Leave to Remain) but then found out my partner was cheating me and we both decided to get seperated, we started the court case in the mean time I visited India ...my home country and my parents convinced me and made me realise about my past mistakes, they itroduce me with this girl who I really like, our family were also very happy and we decided to get married as soon as I get my final divorse (dissolution) from UK Court, now I am married to this girl in India who I really like but I am just concern about that will Homeoffice give her spouse visa or they will refuse on the basis that I've married her soon after getting dissolution from court, although court dissolution means that I am free to marry again????

Please help

Obviously they will suspect that this is a sham marriage intended to settle someone in the UK and facilitate further chain migration. They may also suspect that your previous situation was not genuine but there is nothing they can do about that now. If I assume you are not an idiot then you must be thinking the same otherwise why are you asking the question? Whether or not their clear suspicions can be sufficiently proven to result in a EC refusal is another matter.

Wha is EC?

But this is not Sham marriage because I've been dating this girl and I've so many proofs such as photographs, itemised billing of calls we have made to each other and all that...

That may be so but it won't prevent them thinking otherwise. Their jobs demands that they view such situations with suspicious scrutiny. However, if there is no proof of immigration abuse then there is no case.
