Dependant visa of child when reaching 21 - HELP please

Post by richarellas » Tue Oct 18, 2011 1:43 pm

Hi, I am a European citizen living in the UK for the past 12 years. I married my wife 10 years ago ( she is from Brazil). She already has indefinite leave to remain as her oldest son. However her youngest son was 14 when he came to the UK and now aged 21 and is still on a dependant visa that expires next year. My wife and I are now separate for 2 years and we want to divorce but we fear that he might loose his visa or not get his indefinite leave to remain. What can we do?

Thanks

What was your wife's immigration status in the UK before she was granted indefinite leave to remain? Why didn't the younger child apply for settlement along with the mother?
