FLRM application

Post by Jason442 » Thu Jan 19, 2012 1:23 am

Hello I am very new to this, but desperately need some light in what am doing. I will try and cut my matter short, My partner is 49 yrs old, and am 36. She is british, while am not. We have been dating and living together for 6yrs now. So a solicitor advices dat we should go to our home country and get married as we are both nigerians. August 2010, I got cought at d airport trying to leave the country with someone documents. And I was giving 12 months, which I did 6months.
While in jail, my lawyer applied for asylum, and an FLRM application, on my behalf. My partner was really worried. I was bailed by my partner, and was asked to report at the immigration office weekly, then I was issued with an ARC id card.
My question is, I have only found out that my asylum application has been refused, but the FLRM is still pending.
At the moment, we are planing to get married here at the registry, I have gone to book a date, but do you think the marriage will be a success?
Am I taking the right step?
(2)outside all this senerio, I have a girl friend that have had a 9 months old son for me, but the issue is dat she applied for a dependant visa that has since been refused. I really don't know what to do, pls advice me.
Do you think my application have any chances of success?
What do u think my baby mother can do?
Thanks

A lawyer can't apply for asylum on your behalf -only you can do that - on what basis did you claim asylum?

I don't quite know what you mean by asking whether your marriage will be successful? Do you mean will it mean you can stay in the UK or do you mean will it last considering you have apparently been with another woman who has had your child whilst in a relationship with your future wife?

Regarding your 'girlfriend' - what is her current immgration status in the UK? You say she applied for a dependent visa - dependent on who?

FLRM APPLICATION

Post by Jason442 » Thu Jan 19, 2012 8:06 pm

wow, thanks for looking into my matter, the thing is, while i was in jail, my lawyer visited me and took a statement off me.
i will quickly brief you about myself. my dad brought me here some 16 yrs ago, becos of some issues back at home, and went back, and since then, i have not set my eyes on him. i was left with an aunty that took care of me for some yrs, and i later moved out. ever since then, i have been here nor there, i have been living underground, trying not to get in trouble. in 2005 i met this my current partner, since then we have been living together.
while in jail, my lawyer filed for article 8 i think.

i will like to know if it will be a success to get married to my partner with my ARC id card that was issued to me by the H O.
becos i am scared that the immigration might come on that day.?
but some few months back, she was domestically abusing me, it got to a stage were i got fearedup, so i went to report to womens aid.
they took up the case, the confidencially told the police. she has got no idea of what is going on.
last friday, i went to sign as usual, and i demanded to know the update of my matter, the lady to me dat she can see that am about to get married? i said yes, and she said that i have been a victim of domestic violence, i replied yes.
i really dont know hw they got to know all this.
pls kindly tell me what you think. thank you
my FLRM is still awaiting result.

Womens aid have been very helpful, cos they have a section for any one that is going through domestic violence.
Due to all her threats, cos she threatens me a lot with stuffs I have not done, she said she will make Sure I go back to jail, so with all that, I knew not what to do. And searched online for womens aid.
And ever since, I have met with the police confidentially, with the help of womens aid. Just to let hem know what am going through.
What do you recon?
Have I done the right thing?

you haven't answered the other questions in my original reply so it is hard to comment further.

Article 8 and asylum are not the same thing. You cannot claim asylum simply by your lawyer taking a statement from you and you can't claim asylum purely based on article 8 (which is about family life). In order to claim asylum you would have stated that you fear returning to your country. You would've have been interviewed by UKBA in order for your application to then be refused.
