Can i reapply while the appeal is pending

Post by life24 » Mon Aug 21, 2006 3:13 pm

Is it possible to reapply for new application while the appeal is pending?

Cause I have appeal and i think the appeal will take too long. The eco refuse to give my wife a visa suggesting that i cannot maintain my wife without recoursces to public funds. I earn £1100 every month pay rent at £350 per month. and I have £1200 in my account and i have never used overdraft facilities.

The Eco also suggest that we are not intend to live permanently cause my wife answer some of question incorect and was unable to give more information about me cause I was not expecting them to ask those question.

But I have appeal but i dont know how long will take so is it possible to reapply for another application while appeal is pending?
the first application wont affect the secon one

when you lodge an appeal, do you have to submitt additional documents with that as well? If you submitted origional documents, for example, your marriage certificate, how can u reapply with the origional documents? I mean, can you really say to them that the origional documents have been submitted with the appeal? I hope u understand what I mean.

My understanding of the appeal process is for you to authenticate whatever information was available or reasonably expected to be available to the ECO at the time of application. Fresh info, except with reference to above, will not be considered.

You can visit www.ait.gov.uk for detailed info

what I meant is that, I did not attach the origional marriage certificate with my documents. The translated version did not have both our signatures. Will I have to attach the origional marriage certificate with the appeal form? If I do that, and it takes too long, how will I be able to reapply without this origional certificate if I decide to make a fresh application?

you can, but I wouldn't recommend it because you generally only have one file, and appealing means the file needs to be with the appeals team, and new app means it needs to be with the applicaitons team. It will probably mean both end up delayed.

Photocopies of documents are accepted for the appeal process. You don't have to attach originals. If you or your representative will attend the appeal panel, u can take along the original
