Hello,

I have a few questions and hope that you guys can help. I'm a US Citizen married to a UK Citizen (my wife). Now we have been living together about 4 1/2 years and been married almost 4 (3 months shy), we also have a almost 3 year old daughter. My wife is wanting to move back to the UK (we have been living in the US) and I'm trying to find out what type of visa or information I need to apply for me and my daughter.

Now my first question is this, I read somewhere if I was married/lived for 4 years I could apply for some type of ILR or similar since we have been married that long. Is this true and if it is, is it the best route to go in order for us to move? I want to work when I get over there (I am an IT guy by trade) and was curious if this would let me work.

Second question is, from my understanding my daughter has US citizenship via being born here (plus with me being a US citizen) and she has/can get UK citizenship because her mother is a UK citizen. Is this true? If so what type of visa would I need to look into for her until we got her over to the UK and registered?

She also Differing settlement visas. Unfortunately, this may change soon.

If child's mother was British otherwise than by descent when child was born, then child is automatically British (2(1)(a)) and may apply for a Consular Birth registration (optional) and/or British passport.
