Spouse Visa review.....

Hello everyone, my name is Michele.... I have a few questions as the time is coming for me to actually submit my application for the Spouse Visa and I am a little scared......

Okay here goes, I am a US citizen married to a UK citizen. I am applying from the US like I am supposed to. I have one son previous to this marriage, and I was never married to his father. We are both planning to move to UK with my husband. Here is a list of everything I am going to submit:

My application (obvious)
My passport
Son's passport
Certified copy of husband's passport
All three of our Birth Certificates (originals)
Passport photos of my son and I
US Marriage Certificate (original)
Notarized letter stating how we met, engagement, marriage etc...
Itineraries for all flights to and from UK for husband and me
Notarized letter from son's father giving permission for son to settle in UK
Sponsorship declaration from husband for me and my son
Employment contract from husband (employed four months)
Letter from employer stating permanent employee, salary 26,200 pounds, full time etc...
Salary slips previous four months
Bank statements four months
Tenancy agreement with at least 6 mo expiry, showing 2 bedroom, 2 story flat in London adequate space for 3 people
Letter from estate agent giving permission to reside
Receipts for proof of deposit and payments made to estate agent
Husbands degree certificate Bsc Computing for Business
Phone records
Telephone bills
Emails
Pictures of all three of us together
Evidence of husband supporting me from UK
My resume detailing great work history as Administrative Asst with great employment references

He doesn't have a council tax bill, utility bill, etc because he just moved in on the 19th of August, before that he lived with parents.

Here is my question though....
His last statement is reflecting a balance of only 300 (pound) in his bank acct because he just paid for deposit on flat and he paid put money on his credit card to pay for my plane tickets and visa, is that going to be a problem? Plus it is at the end of the pay period for him because he gets paid once a month every 25th. I am worried that we will be rejected due to not passing the financial test. He has no savings acct that is his only bank acct….

Please tell me what you think regarding my case, and if I can help anyone else going through this please don't hesitate to ask.

Michele, the first point to make is that you will not be just making an application for a spouse visa ... you will be applying for a child settlement visa as well! Whilst that in itself does not add to your list of supporting evidence, it does mean filling in two application forms and paying two application fees! Form VAF2 will be used for each application, and as regards the completion of your child's form, complete it as if the child was personally completing it! The only difference is that you will sign the form using your normal signature.

The current fee in US Dollars is $494 ... each .... but do appreciate that the fee is set in Pounds .... £260 .... and then converted into local currency by the local British Mission in each country. In other words don't be surprised if the fee is a bit different from $494 each when you come to pay.

I think your list of proposed evidence is good, and especially like the fact that you are including "Notarized letter from son's father giving permission for son to settle in UK". That aspect is often overlooked.

So go for it! How do you propose to apply? It is recommended that you apply online ..... click here .... and after you have completed the applications note the instructions on screen as to where to send the supporting evidence.

With such comprehensive evidence I would expect the applications to be dealt with speedily.

You have made me feel a million times better; I guess I just needed to be reassured in a way. My husband and I are aware of the visa fees and thankfully have budgeted for them :D I hope all goes well; I have been up all night trying to get all my paperwork sorted because I am applying tomorrow, via the same link you sent me.
