Wife's visa extension - Tier-1 dependant or spouse?

Post by smacky » Thu Mar 03, 2016 1:03 pm

Dear experts,
Here's my situation:

My route:
TIer 1 --> ILR --> British Citizen

Wife:
Tier 1 Dependant entry clearance --> Tier 1 Dependant extension after I got ILR --> extension needed for 6 months to complete 5 years --> ILR

Could you please confirm if she can still get extension as a tier1 dependant even though I'm a naturalised citizen? Will she use SET(O)?
I've heard the 5-year clock gets reset if she switches to a spouse visa so just want to understand implications.

It is the Tier 1 Dependent form for an extension. She will also have to pay the immigration health surcharge.

https://www.gov.uk/government/publicati ... -dependant

Set(O) is for ILR as a PBS migrant/dependent.

Yes, switching to spouse visa on FLR(M) will reset her clock to zero and she will have to wait another 5 years for ILR.
