Help - bereaved partner route

Hi, I really hope someone can help.

My British husband and I married in 2016. I applied for a spouse visa in January 2017 and my solicitor advises that we are still awaiting a decision. Unfortunately my husband died last month and my solicitor is now saying I have no right to remain in the UK as he died before I was granted a spouse visa and therefore cannot apply for a visa under the bereaved partner route. They have notified the Home Office of his death.

I have so much to deal with without this worry. I am currently in the UK on a visitor visa expiring on 1 September 2017.

Please can someone help? Do I need to leave the UK before 1 September?

Did you apply from your spouse visa while in the UK on a visitor visa?

To be honest, you are asking a very specialized question, I think you should seriously consider consulting a specialist agent, to get the informed answer and to plan a route forward. Because rare people has deal with this kind of situation.

No doubt the forum 'hive mind' can give some advice and the OP has already lost faith in their legal advisor. The answer to the previous question as to whether the Spouse visa application was submitted while in the UK as a visitor is crucial. :idea:
