Extending residence permit as a spouse

Post by Qwerty123456789 » Mon May 21, 2018 9:20 pm

hello there!
me and my wife married for 3 years, she got her residence permit for 2,5 years,by applying from outside the UK, which expires end of summer.
I have residence permit, she is not EU country citizen.
she has been working in the UK for the last 2 years and payed her taxes as PAYN.
my questions:
1. can she apply for permanent residence/indefinite leave to remain or any other long term stay visas or only extension to existing one (29-33 months term) and only then applying for ILR?
2. what financial/maitenance requirement,( minimum figure) does she/I need to submit to support visa application?
3. does she still need to pay for IHS ?
4.she had pass her A1 when was applying for residence permit as family member just over 2 years ago, does she need to submit any other certificate , and if yes which level?

thanks a lot

Your post is somewhat confusing. You mention that you wife was issued with a 2.5 year residence permit. Do you mean she has a spouse visa issued under the UK Immigration Rules? :?

In which case she has a visa, not residence permit. Your wife will have to extend her visa for a further 2.5 year period before qualifying for ILR.

Either single or joint earnings must meet the minimum income level of £18,600 p.a and A2 level English is required from a test on the UKVI approved list. I suggest you read page 64 in particular for the documents she will be required to submit in the form linked below.

I've moved your topic to the correct sub-forum.

In addition to the visa fee, your wife will also have to pay the £500 IHS. This is due to double later this year.

does she need to submit biometrics again at post office even if she had done it 2 years ago in visa centre outside the UK?

she will have to enroll again her biometrics details at post office and will have to redo same during next extension/ILR stage.

Previously, for spouse visa applications submitted prior to 9th July 2012 the route to ILR was 2 years. Your wife is on a 5 year route to settlement (2.5 x 2.5).
