Tier 1(General) dependent ILR - Absenses

Post by tbnag » Wed Mar 06, 2019 9:09 pm

Hi All,

Sorry if this is already asked. Is it true that 180 absence rule ONLY apply to PBS deponents who get their INITIAL visa after 11th Jan 18?
I was on the impression that it applies to ALL PBS dependent, but if their initial visa grated prior to 11th Jan 18, then previous absences are not counted but absences after 11th jan 18 are counted. This seems to be not true, as per below thread.. Seems the absences after 11th Jan 18 is also not counted.

indefinite-leave-to-remain/spouse-ilr-1 ... 76303.html

My dependent first arrived UK on Apr 2015 and are eligible of ILR on Apr 2020. Their most recent visa extension was on Oct 2017 and no more extensions needed, only ILR. Does their absences after 11th Jan 18 counted?

Thanks!!

Hi,

I think the below link answer my question. Since our extension is prior to 11th jan 18 and no more extensions require for ILR, we will not fall into this rule. So absences after 11 jan 18 doesn't count.

If anyone think my understanding is incorrect, please let me know.

Thanks!!

Kindly refrain from posting third part weblink.

Absence is only relevant to those who have visas issued after 11 January 2018.
