Which Spouse visa after my ILR( 10 years )

Post by Atif786 » Fri Mar 15, 2019 2:44 am

Hi Zhou’s and all the respected moderators and mentors of this forum , I need some advise beforehand so that I can get paper work ready for my wife’s visa application .

I am planning to apply for my ILR ( 10 years route )
In mid of April .
I am on tier 1 ent visa and wife has been my point based dependent since June 2011.
Which visa Categiry do I need to switch her visa to .FLRM ? Or SET M ?
Elbglush skills - A1 level trinity college london ?
Finincial requirement - £18600 for wife and with 2 kids £24800 ? Even tough kids won’t be included in dependent application as i’ll Be applying for their british nationality .

Couldn’t find complete policy guidance where I can see all documentary requirements
Finincial and cohabitation.
Can someone share the link of policy guidance plz
Thanks .
Atif

If you will apply ILR under long residence then your wife will have to switch into FLRM that will reset her clock to zero towards ILR. However, if you applies ILR under PBS tier 1 ent visa after 5 years and if she have also lived 5 years & even if not then she can apply its extension without resetting her clock towards ILR.

Not sure what 'policy guidance' you are seeking, but the links below will be useful, especially if you opt to go for 10 year route ILR, which means your spouse has to change visa category, which does not apply if you apply for ILR based on PBS route.

Hi Cr001, Thanks for your reply, my current visa is valid until oct 2019 and i am eligible for both 10 years and tier 1 ent( ilr) route from mid april, the reason i want to go for 10 years ILR as i can go for Super priority services which is not available for Tie 1 Ent ILR route.
so she needs to fill in FLRM Form ?
and i was looking for a UKVI policy guidance where i can find out the financial requirement and cohabitation documents to be submitted with application.

i have following documents in our names, if the are enough ?
Joint Name:
Tenancy Agreement ( 2016-2017, 2017-2018, 2018-2019)

Thames water bill ( for the same year as above and for 2019-2020 as well.

Council Tax Bill- 2016-2017, 2018-2019, 2019-2020 ( however the one from 2017-2018 is missing ) requested council to send me a copy but they said can only be online version through email and it will take time, is it acceptable as won't be original).

Individual documents :
My Wife:
Bank Statement from lloyds for the last 2 years ( will request them to send copies by post )
Full UK Driving Licence Valid from Aug 2017
Credit Card statement from Barclays or Vanquish for last 2 years ( need to order copies )
Car insurance papers- Valid from sep 2018-Sep 2019

Myself
First Utility bills ( need to order )
bank statements ( need to order) ( i have 2 accounts)
Credit card statement ( need to order ) ( i have 2 accounts )
full UK Driving licence ( valid from July 2016 at the same address )
Virgin Media Bills ( Need to order)

all of the bank and credit card statements are online only version , so are the print outs acceptable or shall i get the bank statements stamped , or shall i order hard copies through post for last 2 years for each and every individual month for them to be accepted.

Financial requirement
i have been on Tier 1 ent so working for my own limited company .
salary 17.5 K before tax
Dividend - 16k
all credited into my personal account every first date of the month .
thanks
Atif

Preferably apply ILR under tier 1 to save your wife's previously spent time towards ILR. Also remember that the decision on ILR through long residence not usually straightforward and almost all the evidences that are needed for tier 1 ILR will also be needed for ILR LR as well.

Thanks for your suggestion , I do have all the requirements fulfilled for Tier 1 ent ilr and the visa is valid until Oct 2019 so I can provide them all the documents if required , I’ll declare this in covering letter as well, reason for ilr 10 years is same day or within a week decision so it means I can travel much quicker as I have my ailing mother to visit .
As far as my wife is concern she’ll complete her 10 years in 2021
So don’t need to wait for 5 more years for her ilr.
And I am not in a hurry to apply for naturalisation

Then go ahead with your plan but if your partner is also willing to travel with you then without switching into FLRM she might be on risk when trying to return.
