Dependent visa on the basis of FLR(FP) visa holder spouse

Post by Imran_Masood » Mon Mar 18, 2019 7:11 pm

Hi,
I hope you are well.

My sister got visa under article 8/ FLR (FP).
She will complete 10 years continuous residency in 12 months time.
My brother in law is in back home.

What type of visa he can apply to join his family?

Many thanks

He will likely have to wait till she has ILR before he can apply for a spouse visa if they meet all the requirements.

My sister is working and have enough monthly income to sponsor her husband.

There must be a way. A friend suggested that my brother in law can only apply "visit visa".

Does she earn a minimum of £18,600pa??

He cannot switch to another visa category IF he can get a visitor visa.

Many thanks for your time and kind replies.

We can just want to apply a discretionary leave (Leave outside the immigration rules). Home Office may use their discretion in our favour.

I have been trying to find the online application for LOTR application. Can you help please?

There is no longer a DLR form for new applicants as far as I am aware.

He would be setting himself up for a long and expensive road, potentially many refusals and no ability to work or use the NHS etc.

Unlikely success if he comes on a visit visit, if he can even get a visit visa, which is probably also unlikely if his wife is in the UK.
