Biometrics app can I get held by immigration

my partner has an appointment tomorrow in Sheffield UK for biometrics
Need to ask what are the chances of him being held / detained by the immigration based on his VISA historY
He came in the UK in 2011 on student visa. Then after his student visas kept getting refused due to the colleges being bogus. He applied for an asylum visa which got refused in August 2018. So he’s been illegal since then
We got married in August 2018 and now have a child British born. I am British born too.

1. How did you get marry if he was illegal in the UK? You need permission from authorities to do so.

2. I assume he's applying for a spouse visa. Why he didn't go back to his home country to apply instead?

3. What's his nationality?

There's a chance that this visa may be refused since no FLR(M) applications can be made from within the UK. Most likely scenario would be that his visa would be rejected, and if you appeal, he would end up on a 10 year route. There has been successful stories from overstayer partners though. I suggest you to read these threads:

I believe it's only from the UK that FLR(M) can be made; currently anyway.

Isn't the 'R' for ' Remain'?

He may have been married during the process of asylum application which might have rejected after his marriage in 2018.

We submitted the case and no interview was taken

(We have done an Islamic nikkah not English marriage )
