Hello all.

This forum is great.

We have put mum application via solicitor nearly paid £3550 fees in pakistain ruppies

I and my British brother are fully settle in London.... our mum do not have any proper care in pakistain, one elder brother in pakistain, not good at all with mum... we have provided all evidence, solicitor letter, police report from pakistain..

British brother, in London, cannot travel because he is suffering from ill health... All evidence been provided... to home office..

My mother application has been received by ukba,, now we are waiting for her health check which need to be done..

My question is any chance or hope for her to get her stay in uk... she came to UK 4 times on visit visa, left within the limit now they are refusing her visit visa application since 2014...

Please share your views..

I got indefinite leave to remain since August 2019.. married to European national, even provided her passport copy as well..

Is there any chance we can take our mum from pakistain to our home in London...... we had enough with our brother in pakistain...

Please share your views...

What have you applied for exactly??

Who is sponsoring your mum for a visa?

For what? Is it to pay for a solicitor in Pakistan or something?

Did you apply for Adult Dependent Relative for her at one point? (Don't)

What is the best option for her to be out of pakistain... money not a issue.. it's our mum safety and our peace of mind to be with her in London..

You have VERY little chance of getting approval for an Adult Dependent Relative visa. It is the hardest visa to get and has a 99% refusal rate. A refusal of this visa will also shut the door to any future visitor visas for your mum.

What documents exactly did you submit with the application?

Unfortunately, 'safety' and 'your peace of mind' are not sufficient to qualify for these visas. You need substantial evidence to prove care is not affordable or available in Pakistan.

I think that put the OP in a "nothing to lose" situation. They have been refusing visitors visa since 2014 because they probably thought she would want to stay in the UK.

Hello all.

As expected mum application has been refused by home office, we have 28 days to appeal...

My question is will this be in court or on paper
We prefer court, as in court, we can present mum case better to judge,

Me (indefinate) brother British citizen are financially strong to look after mum in England..

Refusal grounds are, we can talk to mum via Whatup, and we are sending her enough money to pakistain, she can live her life peacefully there. Very silly and stupid reason in my view...

We do not take any benefits...

I suspect you will need a better legal argument than this for a successful appeal. The links posted by CR001 have much information related to the eligibility for this type of visa and it is not at all clear how your application demonstrated meeting these criteria so it is difficult to provide any helpful advice.

My mother (over 60) settlement adult dependent visa have been refused...

Her case has gone for court hearing now, waiting for a court date....

I wanted to know how do we prepare as sons of her, *we have good solictor* but still wanted to know...
If there are any tips... to get success I court ...

It seems that you have been ill-advised by your solicitor. If you have read the information in the links posted by CR001, you will see that in order to have a glimmer of hope in getting the decision overturned, you will have to prove that your mother needs help for daily tasks such as bathing, dressing, preparing food etc. and that care is either not available in her home country, or is not affordable.

As she has a son in Pakistan and the care/medical costs in her home country are less than they are in the UK, the chance of obtaining an Adult Dependent visa is considerably weakened. The fact that you have been supporting her financially, also reduces the likelihood of success with an appeal.

Your solicitor should have warned you of this before you applied. :idea:

On another point, you mention that your mother is 'over 60'. This isn't considered elderly in the UK and the retirement age is currently 65, with many women continuing to work beyond this age.
