Spouse Visa Requirements (Indonesian Wife)

Hi Folks,

Thank you in advance for any replies.

My wife will soon be applying for a Spouse visa to enter the uk, and stay at my home address.
One thing that is slightly confusing us, is whether or not she reqires an IHS reference number, for healthcare.
I'm confused because on the one hand it says she is applying from outside Europe, and therefore she does need one.
But on the other hand it says she doesn't need one if she is applying for indefinite leave to ENTER or remain.

Can anyone clear this up for me please?

She is NOT applying for indefinite leave to enter or remain. This option is no longer available for spouse applying form outside the UK, removed in 2012.

She is applying for an initial spouse visa, valid for 33 months, and IHS of £1200 is payable when she applies for her visa in addition to the visa fees.

Note the IHS reference number for visa purposes is not the same as the NHS number she will need for NHS services once she arrives.

The fees I came across on the Government website today were £400 per applicant, and not £1200, which is a big difference. Is there a reason why you think it's different to that listed on the website?

You must ensure you apply for a spouse settlement visa, not the cheaper 'marriage visitor visa'. However, it appears that you my be confusing the NHS fee of £400 per year.

The visa fee is currently £1,523 + £1200 NHS charge

Just one more thing. My wife currently has a 6 month visitors visa, which will expire in March 2020.
She came over to the UK for a 2 week holiday recently, and returned to Indonesia on the 6th October.
Am I correct in saying that she can still apply for her spouse visa, while her visitors visa is still valid?

Spouse visa doesn't falls under pbs system and there is no tier attached to it.

If my wife is bringing her 5 year old son with her to the UK, does he require a separate application, or is he included as a dependant within her spouse visa?

You need two vaf4a and two appendix 2.

Does she have sole responsibility for the child?? Where is the child's father??

Yes she does have a letter from the father giving consent.

If she needs consent then she likely does not have sole responsibility. See link below if what HO terms sole responsibility. HO would expect to see official documents.

What documented evidence of sole responsibility does she have apart from the father's letter giving permission? Is there a Court consent order? Has the father played a part in the child's upbringing?

No it is not. The PAPER version is for north Korea. Online for everywhere else. Vaf4a is the spouse settlement visa form.

So she can complete the spouse visa, and add her son (sole responsibility granted, as a dependant, through completing the appropriate appendix?

She has a stamp in her divorce certificate, giving her sole responsibility for her son. The father has had no input or relationship with his son, since birth.

So we complete 2 X vaf4a, one for my wife, and one for her son, plus any relevant appendix?
