Can my partner apply for Australian visa while I apply for ILR?

Post by bluecard » Thu Oct 29, 2020 3:27 pm

Hello,

I am an Aus citizen living in the UK, married to UK citizen.
I have FLR(M) and can apply for ILR from November 2021.
My husband and I want to move to Australia for a while in the future but I would still like to get ILR here before we go to keep our options open.
My partner wants to apply for Australian visa 309. With the waiting times for this visa being up to 25 months, could he apply for that now? Will that impact me applying for ILR next year?

Thanks for your help.

No impact but you might be asked a question about it which you will have to reply truthfully. In spite of that, a spouse visa holder is expected to settle and live permanently along with his/her family members in UK.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.
