HAVE A SIMPLE QUESTION, HOPE ANYONE CAN HELP,


MY FRIEND HAD A HEARING TODAY AND JUDGE ACCEPTED THEIR RELATIONSHIP AS DURABLE, DOES THIS MEAN THEY WILL WIN THE APPEAL !


PLZ ANYONE WHO GOT ANY INFORMATION OR IN A SIMILAR CASE, ANY ADVISE

In so far as the relationship is durable: court speak for they believe you are married for the right reasons and that the relationship is evident and being sustained. In short a real marriage, not a sham or a marriage of connivance.

It does not mean the appeal will be won though. Accommodation and maintenance are the next points to be considered. Only if all three are demonstrated / evidenced will the appeal be allowed.

BEST NOT TO USE CAPITAL LETTERS TO POST - it is the internet equivalent of shouting.....

accommodation and maintenance, what do u mean ???

but as far as i know, u dont have to be married to prove a durable relationship, by the way they both live and work in this country and have a child,

another question please, when a judge make a decision, what happens afterwards, do they send it to HO to prove it again as well or ??

cuz he said he accepted a durable relationship but the HO should also agree (something like this)

It will be easier if you gave the full story rather than bit by bit. It will save time in the long run.
What status does each person have?
Where are they living at present - rented, shared or owned accomadation?
On what basis was the application made?
Is there any relience at present on on public funds?
Is either of them an overstayer, an illegal or a failed asylum seeker?

well they are both working at moment and renting a flat together with their child, the application was made on the basis of proxy marriage. and no reliance on public funds at all. one of them is European, Swedish and yeah the husband is an overstayer...


so what do u think ?
