Application for child outside UK, parent with ILR

Post by dreamseeker30 » Sat Nov 20, 2021 6:08 pm

Dear Sir/Ma'am,

I'd like to thank you for your time in reading my post.

I am a single mom of an 8 year old born and living outside UK. I have received my ILR status just this month under the tier 2 5 year route.

I would like to bring my son to the UK to live with me. What application route should I follow please? And may I ask to provide me with the link please?

I am planning to apply for citizenship next year. Will my son be eligible for that if he is in the UK by that time? Or would he need to be in the country for a specified time before applying?

I look forward to your guidance on this matter. Thanking you.

Where is the other parent?

Have you had sole responsibility for the upbringing of your child?

I don't know where the father is. He is not British nor Filipino. We haven't spoken in years. He has no input in his upbringing and has not acknowledged him as his.

Thank you for the links. They are very informative.

I had a look on the website. Which of the 2 is the correct link for me to follow please?

Apply as a child (family visa)
https://www.gov.uk/indefinite-leave-to- ... amily-visa

Or

Apply as a child (dependent on a work visa)
https://www.gov.uk/indefinite-leave-to- ... -work-visa

Or none of these is the right one? Thank you in advance

Application guidance please: child to join parent with settled status

Post by dreamseeker30 » Thu Aug 11, 2022 7:16 pm

Good day everyone. I would like to ask for your guidance and expertise to be with my son again.

I am from Philippines and have a child who is born 8 years ago and residing there who I wish to join me here in the UK and stay with me. I have received my ILR only last year. He has never visited the UK. I want him to also be settled here with me.

I have gone to the HO website and there were two options that was confusing for me. Which category should I choose
A) Non british child of a parent, parents or relative who are British citizens or settled in the UK.
B) Non british child of a parent granted or currently applying for permission to enter and stay in the UK, as the parent of a child who is a British citizen, settled in the UK ornin the UK with pre-settled status under the EU settlement scheme
Please let me know what is the correct one.

I chose the first option as it seems to be more applicable to me and the appendix it was giving me is VAF4A appendix 2, financial requirement form. Advice to me before was to fill out VAF4A appendix 1. I have inquired about this before in this forum but there has been almost a years gap since then and I wanted to confirm of any changes please? Is there any other additional form I need to fill out?

Following this 1st pathway, it was asking me to provide evidence of english language. For an 8 year old, what would be applicable for him please?

I am a sole parent and have had sole responsibility and custody of him since he was born. What evidence can I provide to support this please?

I appreciate your time for this and I look forward to your help. Thank you.

I think the previous advice was correct.

Can you list the paths and options taken that were available at each stage?

Good morning. Thanks for replying Vinny. I saw this post yesterday while searching for an answer and followed the pathway. I followed the instructions on the hyperlink from that forum
1. Join or accompany a family member working in the UK
2. The option with the settled status
And for the last one where it shows the amount I chose Non british child of a parent, parents or relative who are British citizens or settled in the UK.

Carried out filling it out and when it got to the additional forms, it showed the VAF4A appendix 2 which made me confused as I was expecting appendix 1. Unless I have chosen a different option than whay I should have which led me to this.

Also do I need to fill out an SU07 sponsorship undertaking form?

Thank you.

I expect Appendix 1 too.

I don’t think that SU07 sponsorship undertaking applies for child’s applications.

This was what made me confused because nowhere in the application did the VAF4A appendix 1 come up. I'm starting to think now that I have chosen the wrong pathway.

I have messaged the customer service for international queries for home office but received a vague reply.

Am I supposed to supply evidence of english language for an 8 year old? Any suggestions please of what I can get for it.

Appendix 1 is a separate document and the link is on the UKVI website.

https://www.gov.uk/uk-family-visa/child
If they do not, you must fill in both:

the online application form
the Appendix 1 paper form

There is NO English requirement for those under 18. Have you input the childs information as the Main Applicant in the form?

https://www.gov.uk/uk-family-visa/child

Will this link lead me to a new application? Or it's just a form that I have to add to the appendix in my application?
