Certificate of entitlement for child born abroad to british parent

Hi,

My son is 7 months old and was born in Afghanistan. I have acquired an Afghan passport for him and currently he resides in Pakistan without any visa as the border authorities do not require infants to have a visa.

My question is regarding certificate of entitlement application;
1. does he need to have a TB test done?
2. when asks about address history he is only 7 months old do i just give my UK address and explain in the box that it is a child application.
3. Do I submit any cover letter?
4. I am filling my wife's application for spouse visa as well when asks about having a child's nationality do I put british or Afghan.

Any help will be appreciated.

If child is British, then put British. Else, spouse’s financial requirements under E-ECP.3.1. may increase per non-British child.

when filling the application there is a question whether the applicant have a temporary visa, resident permit or do not have a visa. Since he does not have a visa does this cause any issue given that the applicant is not legally residing in Pakistan and there is no visa centre to make application from the country of origin.

Vinny, regarding the child's nationality isn't he automatically considered as british given that he is born to a british father naturalized prior to his birth.

P.s in this application of CEO the applicant is asked whether had or have any other nationality apart from the passport one held. So do I put that he is British National and date of citizenship held is his date of birth or do I leave it blank. From my understanding CEO is given to those who are exempt from any immigration rule, therefore the child must be british to be granted CEO or am i reading it wrong.

Yes. Child is automatically British, if father was naturalised prior to child’s birth. Moreover, a child born from 1983 has a RoA iff child is British. If born before 1983, some Commonwealth non-British nationals may have a RoA.

So, put “British” and don’t leave it blank, simply to highlight child’s eligibility for a CoE-RoA.

Many thanks, vinny and do you have any opinion on whether my infant not having a visa in Pakistan will cause any issue in the application. I selected do not have a visa and explained briefly that the pakistani border with afghanistan have issued compassionate policy to allow children pass freely given their parents hod a valid visa. will this suffice?

Moreover, when selecting documents it still asks to tick off the box for evidence of permission to be in Pakistan. it does not allow to pass this section without ticking the box off.

No as the passport was acquired in Pakistan from the afghanistan consulate. so as a explanation I stated that due to the new policy I was fortunate to take my child across the border and acquire a passport for him from the afghan consulate in Pakistan, hence the absence of pakistani visa on passport.

The above explanation you provided should suffice and not having visashould not be a problem.
