Residence requirements - special case

Post by TheUKresident » Sun Apr 13, 2014 1:03 pm

I'm planning to apply for BC very soon on a special case. I obtained my ILR in Aug 2011 based on Tier 1. Although at that time I already lived in the UK for 10 years. In Nov 2011, I moved to US with my firm, however, I was employed by its US entity. 17 months later in Apr 2013, I moved back to the UK with the same firm on a permanent basis. My absence was about 580 days which is a lot more than the basic requirement. However, I do have a home here in the UK which I bought in 2010. I also got married in 2013 and my husband who is a US citizen moved to the UK with me who has full time job in the UK and we intend to live in the UK. I meet other criteria. Given the absence, I am planning to apply based on the 2 year residence prior to the 5 year qualifying period so that the excess absence would be disregarded. This is on the provision that I have a home and established a family in the UK (no children though). Could anyone who is in a similar situation or come across with this type of exceptional cases advise what documents I should provide and how likely the application would be successful? Thanks.
