You stated that the CSA could get all the money that is owed, that is simply not true. They may be able to get the money, but it's a big may at this stage depending on a number of factors, most importantly if he returns to the UK anytime soon.

Regarding SMI, despite me correcting you with reference to the legislation you are trying to rebut what I stated. I suggest that you read Liability for housing costs (click) at pages 105 chpater 23423.
Example 2
Harry lives with his mother who has a mortgage on their home. Harry’s mother dies
and her estate becomes liable to meet the mortgage payments. But she did not
leave a will and her estate is not making any payments. The building society cannot
transfer the mortgage to Harry until his mother’s estate is settled. But they agree
that if Harry pays the mortgage he can carry on living in the home. It is reasonable
to treat Harry as liable for the payment of mortgage interest and housing costs for
mortgage interest are allowed.

The child maintanence you get from the father will not reduce any welfare payments you will be given. The child maintanance will be extra money for your child and is not counted in benefit calculations.

Ah, yes, in that post I did. I can admit I was wrong, but why can't you? What you said about the CSA, was wrong.

However, what I also added in my posts was they can only get the money from when they contact the CSA, so obviously it won't be all the money owed. Prison will also make it hard to get the money, but at least the parent gets punished for not wanting to help support their own child.

I've always found that the ones who try to discourage parents from going to the CSA, are either a parent who doesn't want to pay for their own child, or a second wife.

Always contact the CSA when the parent won't pay. It won't affect your benefits if you get maintenance for your child from their father. If that parent goes abroad and they are in a REMO country then the order is still enforceable, or enforceable if they then move to a REMO country in the future.

Yes you did highlight the other forms of enforcement even if they are immaterial to the OP.

I do not appreciate the indication that I am either a 'second wife' or a parent that does not 'pay'. Neither of which is true and just displays ignorance. I am merely highlighting what happens based on experience in dealing with main maintenance claims. The OP in this case may be better off with an ancillary relief order when the decree nisi is given.

And I fill the form of claiming housing benefit and local tax cool tax support
But it's strange that I dun have income .. No benefit ( at that moment ) no rent .. Anyway I will try to hand in the form and write a simple explanation on my situation .. Can't wait till meet with CAB ..
My money is going quick
Between .. Actually my mortgage is around £360 per month .. It's like a figure if I really rent out .. Or even less .. Hope I really can get help on housing ...
And child benefit will change to my name ASAP then I can get income support ...
Dun want to waste week by week

With you having £4000 in savings you'll be unlikely to get help from the Community Support Scheme re; Crisis Loan.

Hi I have been CAB today which is unhelpful
As expected, I can't claim income support until child benefit in my name.
I have called on last Saturday asking cb but they said not yet receive my application , no update in computer system.
The CAB is really nth .. She help me to ask hardership money , but as I got some saving .. Application on phone was rejected.
The CAB staff just said .. Oh.. Then after u get the CB, u go to job centre and fill in the form .. As I know must do online or on phone ...
I ask about after I got income support .. Can I Ho back to school with any grant or loan on a subsiderary BTEC full time course .. Again she said she dunno
About mortgage help .. She said no help unless I rent out .. Then I said the mortgage is only £370 .. I may even need paid higher .. She suggest me to stay in current house and try to apply help after 13 weeks of income support .., so.. That's what CAB can do ??

Oh dear a poor service. I'm afraid CABx are slipping down now due to losing so much funding and inadequate training of staff. Focus is moving towards diagnostic gateway assessments and away from a general advice service. This is negatively impacting clients.

A JSA hardship payment wouldn't be applicable unless you've been sanctioned. Community Support Scheme is likely unavailable due to savings. Get the claim in for ChB then as soon as that is suspended a claim for IS including SMI. One month for MR of DWP decisions and 30 days to appeal ChB decision.

Sorry .. I dun understand what u mean in the last sentence .. After I got child benefit .. Then go straight to income support and MR... Appeal ???? What appeal ? I think I need a new claim after child benefit in my name ..

Then should I do appeal now before child benefit or after child benefit .. Make a new claim with dateback or go appeal within one month

Oh .. Dun fear me .. I never feel child benefit will be rejected .. I simply fill form online and send back without any explanatory letter ... Should I write a letter again ..
As I called ask for form and said abt the situation zz the staff just ask me do online ..

Child benefit call me on last Friday and I explained
I call on sat to see any result and I was ok to change .,
First payment of £20.8 pay shortly .. then 14/5 every four weeks.
Today I call for income support claim
But as I dun have my child benefit letter in hand .. I dunno which day is my entitle
I just claim IS from today ..
Can anyone suggest when will I get confirmation from child benefit
And any chance to change the date of claim start ?
Staff give me 0345 said discuss with them .. My phone run out if credit this months .. Always call HM

Sounds like it couldn't be delivered and was returned to sender. Was the address correct and written clearly?

I just called 0800 they ask me to call another charge no

They said the system doesn't show up any statement received!!
I posted over a week !
Then said I should call again until next tue
Just waste money to call
