FLR M Help

Would love some help.

I married my wife in the Philippines 2004, she fell pregnant and towards the due date I came home to UK to get the house sorted expecting a straight forward birth.

Anyway, our baby was born with a heart problem and had to have a costly operation in Manila, and we applied for his British birth certificate and passport, my wife then applied for a visa to come here as a spouse.

She was issued her visa in October but didn't enter the UK until the November (giving me time to sort things here) and later had a major operation at Great Ormond St.

We now want to return to the Philippines as we have bought a house there and now have a new baby, but our 6 month stay would coincide with her visa renewal, we are told she is able to apply for FLR M but not the SET M due to her entering the UK 1 month after the visa.

How long will a FLR M last, and why can't we be issued with a Set M before the due November date, also can we apply for the FLR M in the Philippines or does it have to be submitted here.

Both kids have UK birth certs and passports, its only my wife who is the subject.

What are the exact dates of the visa and of her entry? If she was only one month late she may just get away with a ILR application.

If not, then she can get a further period of leave for 2 years. She can apply either in the UK or the Philippines but it may be better for her to do it before she goes.

Hello and thank you for the reply. Sorry for the lateness but we have been unable to access the net.

My wife was issued the visa on 4/10/05 and entered the UK on the 4/11/05 so it was maybe a month between the issue date and the enter dates, we are going to make an appointment at Croydon to get a FLR M which is what we was told on the phone to apply for.

We was told my wife missed out on the ILR due to the outdated visa because of the entrance date.

She qualifies on 4/11/07, and can apply 28 days before this, so if you have all the supporting documents there is no reason why she can't apply on 4/10/07 and get approved - if she applies by post. If she goes in person they may be picky about the extra couple of days.
