The fiancee visa application should be accepted if you can show that your divorce will be finalised within the six months of the visa being issued, enabling the marriage in the UK to take place within that time. However, if you don't have the decree nisi and the petition for divorce hasn't been served yet the application is highly likely to be refused.

Decree Nisi is the step before Decree Absolute which is the actual divorce.

If the process isn't started yet budget 6-9 months to complete, these issues very rarely go smoothly or in total harmony.

If you aren't familiar with the terms and process engage a good solicitor budget £2/3k for that, mine cost £1.5k 8 years ago totally uncontested but fecking solicitor was charging me £130/hr and the office girl on minimum wage was doing the actual work which was tardy and shoddy.
