ILR for Spouse

Post by Karthee3 » Tue May 13, 2014 2:32 pm

Hello,

I was granted ILR earlier this year. My Spouse was granted visa in August 2012 and came to UK in August 2012. I would like to know the ILR options available for my Spouse. She is currently on tier 2 ict dependant visa and is valid until Jan 2016.

I am looking to change my job. Does this affect my Spouse's visa status?

Did you settle as a PBS applicant?

Does that mean my Spouse has to remain on this visa until she completes 5 years?
If I switch my job, is it legal for my Spouse to continue stay with the current tier 2 ict dependant visa?
Or should I switch my Spouse's visa as partner of settled person using FLR (M)?
Or can my Spouse directly apply for citizenship as a partner as British citizen when I get mine?

We are both working at the moment. Pls clarify.

As you were granted ILR as a PBS applicant, your spouse, may continue as a PBS dep until such times as she qualifies for settlement, it is immaterial if you change jobs.

My Spouse will be eligible for ILR in August 2017. Her current visa as PBS DEPENDANT expires in Jan 2016. Should we apply for extension as a PBS DEPENDANT before Jan 2016? But on the extension form for pbs dependants, there is no option to choose spouse of a settled person. Options available are partner of tier 1, 2 or 5 visa holder. Which form should we use for extension?

Also, when I get my citizenship early next year, will my Spouse be eligible for citizenship as partner of a British Citizen?

Just tick t1 if you settled as a t1 applicant. She cannot apply for citizenship until she has ILR.
